Terms of Service

1. Introduction

Welcome to Talk Shawk ("we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of the Talk Shawk application, website at talkshawk.co, and all related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Talk Shawk.

2. Eligibility

Talk Shawk is strictly for users aged 18 years and above. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable laws of Pakistan or your jurisdiction
• You have provided accurate age information during sign-up

If we discover or have reason to believe that a user is under 18, we will immediately terminate their account without notice or refund.

3. Account Registration and Security

To use Talk Shawk, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials and not share them with others
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account
• Not create multiple accounts to evade bans or restrictions

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or remain inactive for an extended period.

4. Acceptable Use

Talk Shawk is a platform for respectful, anonymous conversations. You agree to use the Service in a manner consistent with all applicable laws and these Terms.

You may:

• Have text conversations with randomly matched strangers
• Use interest tags and city filters to find relevant chat partners
• Share images in chat where the feature is available
• Purchase and use coins, sticker packs, and premium subscriptions
• Report users who violate these Terms

5. Prohibited Conduct

You must NOT use Talk Shawk to:

• Harass, bully, threaten, or intimidate other users in any way
• Share, request, or distribute child sexual abuse material (CSAM) — this is a zero-tolerance offence and will be reported to law enforcement
• Send sexually explicit or pornographic content to non-consenting users
• Engage in hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Spam, solicit, or advertise products, services, or other platforms
• Impersonate another person, organization, or Talk Shawk staff
• Share illegal content or encourage illegal activity under Pakistani law
• Distribute malware, phishing links, or harmful software
• Attempt to collect personal information (real names, addresses, phone numbers) from other users for malicious purposes
• Exploit, manipulate, or reverse-engineer the Service, its matching algorithms, or its infrastructure
• Evade bans by creating new accounts after being terminated
• Promote self-harm or suicide — if you or someone you know is in crisis, please contact a helpline immediately

Violations may result in warnings, temporary suspensions, permanent bans, or reports to law enforcement, at our sole discretion.

6. Content and Messaging

• Chat messages are transmitted in real-time and are generally not stored on our servers
• You are solely responsible for the content you share in chats
• We may use automated profanity filters and moderation tools to enforce community standards
• We reserve the right to review reported content and take appropriate action
• You grant Talk Shawk no ownership over your content, but you acknowledge that messages sent through the Service may be viewed by your chat partner

7. Premium Subscriptions, Coins, and Purchases

In-App Purchases

• Talk Shawk offers premium subscriptions, coin packs, and sticker packs available for purchase through Google Play Billing
• All prices are displayed in the app at the time of purchase and may vary by region
• Coins and sticker packs are virtual items with no cash value and cannot be transferred, traded, or exchanged for real currency

Premium Subscriptions

• Premium subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel your subscription through Google Play Store settings
• Premium benefits are available only while your subscription is active

Refund Policy

• All purchases are processed through Google Play and are subject to Google Play's refund policies
• We generally do not offer refunds for coins or sticker packs that have already been used or consumed
• If you believe a purchase was made in error or without your authorization, contact Google Play support or email us at support@talkshawk.co
• Accounts terminated for Terms violations are not eligible for refunds of any kind

8. Intellectual Property

The Talk Shawk name, logo, design, code, features, and all related intellectual property are owned by Talk Shawk and protected under applicable laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted, secure, or error-free operation of the Service
• Accuracy or reliability of any information obtained through the Service
• The conduct, identity, or intentions of any other user you interact with

You acknowledge that Talk Shawk connects you with anonymous strangers and that we cannot guarantee the behavior, identity, or intentions of any user. You use the Service at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Talk Shawk and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, profits, or goodwill
• Emotional distress or harm arising from interactions with other users
• Unauthorized access to or alteration of your account
• Any content or conduct of third parties on the Service
• Service interruptions, bugs, or technical failures

In no event shall our total liability to you exceed the amount you paid to Talk Shawk in the twelve (12) months preceding the claim, or PKR 5,000, whichever is less.

11. Indemnification

You agree to indemnify, defend, and hold harmless Talk Shawk and its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another user or third party.

12. Termination

• You may delete your account at any time through the app (Settings > Delete Account)
• We may suspend or terminate your account at any time, with or without cause, and with or without notice
• Grounds for termination include, but are not limited to: violation of these Terms, fraudulent activity, or behaviour that harms other users or the Service
• Upon termination, your right to use the Service ceases immediately
• Any unused coins, sticker packs, or remaining premium subscription time will be forfeited upon termination for cause
• Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Pakistan.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify users through the app or by updating the "Last updated" date at the top of this page. Your continued use of Talk Shawk after any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service and delete your account.
